THE AUSTRALIAN TAXATION OFFICE CAN WITHOUT WARNING TAKE A STATUTORY CHARGE OVER ASSETS OF A TAXPAYER We have received a number of enquiries recently in regard to the Australian Taxation Office seizing assets of taxpayers who have not paid their outstanding taxes. Once the Australian Taxation Office have seized assets, those assets are not available for the taxpayer to use in resolving financial problems being experienced. Consequently, available options can be limited and liquidation or bankruptcy may be required. Entities experiencing financial problems should take action to resolve the problems before a notice is issued by the Australian Taxation Office to seize assets. For your information, see Nicholls & Co’s ‘Fact Sheet’ which summarises actions which the Australian Taxation Office can take to seize assets.
