You can travel overseas during bankruptcy for holidays or work.
Prior to leaving Australia, you must apply to your Trustee for permission to travel overseas and obtain your Trustee’s written consent.
This form should be completed and returned to allow us to process your travel request.
In short, to be able to process your travel request we will need:
- Your reason for the proposed trip, eg, holiday, visit sick relative, work, etc.
- Countries you propose to visit
- The date you intend to leave Australia
- The date you intend to return to Australia
- If someone else is paying for the trip, the cost of the trip and we need a letter from that person confirming the arrangement
- An email address, telephone number, and overseas address where we can be contact you if an emergency occurs
At Nicholls & Co our policy is to approve overseas travel if you are working with us in a timely manner, maintain good communication, and are doing the right thing.
If you are not responding to our communication or are behind in meeting your obligations, we may require you to bring the same up to date prior to authorising the travel. If we have grave concerns regarding your bankrupt estate (eg, assets missing) and your being overseas could jeopardise your bankrupt estate’s administration, we may refuse to authorise your travel at that time.
At Nicholls & Co we understand that whilst you may be bankrupt, people do need to travel, and we are more than happy to approve travel during this period. However, if it is found that you are seeking the protection of bankruptcy and intend to be non-compliant during this period, we ask that you do not come to Nicholls & Co and put us in the position of having to refuse your travel request.
