Gambling and Bankruptcy

Gambling and Bankruptcy

There are a few things that are important to understand with gambling and bankruptcy:
The first thing worth noting is that if you have gambled socially and have not engaged in deceiving activity to hide assets or fund your gambling, you will not be in trouble.
There are two main considerations when it comes to gambling:

  1. What happens if you gamble during bankruptcy, and
  2. Whether your gambling before bankruptcy was reckless causing your financial position to deteriorate.

We advise against gambling during bankruptcy as all monies you win must be paid to the bankrupt estate. If you win the lotto, the trustee will use the money to pay dividends to your creditors. If your win is large enough, the money will be used by the trustee to pay the creditors in full and cover the costs of the bankrupt estate. Your bankruptcy will then be annulled, and any remaining monies will be yours to keep.
If you struggle with a gambling addiction, we recommend you get help and make an appointment with your doctor, as it will not help your future to continue gambling whilst bankrupt.

Gambling Before Bankruptcy

If before becoming bankrupt, you have gambled socially and have not engaged in deceiving activity to hide assets or fund your gambling, you will not be in trouble. It will only be a problem if you have actively engaged with deceitful activity to fund your gambling or intentionally gambled in a rash or hazardous way, to the disadvantage of your creditors.
It is not uncommon for people who enjoy the occasional bet to be unsure where the line is, for when their past gambling becomes a problem if they become bankrupt. We have reviewed reported gambling prosecutions by the Australian Financial Security Authority (AFSA). All prosecutions we reviewed related to what appears to be deceptive behaviour – causing assets to be lost or creditors created from the gambling to be included in the bankruptcy.
We could not find a prosecution against a person who enjoyed a social bet each week.
